Terms of Service

Welcome to Cupd.

These Terms of Service (“Terms”) apply when you access or use the Cupd. mobile application, website or related services (“Cupd.”, the “Service”). By creating an account or using Cupd., you agree to these Terms.

1. About Cupd.

Cupd. is a social coffee platform that allows users to capture, rate and share coffees, discover cafés and interact with other users. Features may be added, changed or removed as the Service develops.

2. Your account

You agree to provide accurate information and keep your account secure. You must not impersonate another person, create an account using information you are not entitled to use, or attempt to access another user's account.

3. Age requirements

You must be at least 13 years old to use Cupd. If the law where you live requires parental or guardian permission to use an online service such as Cupd., you must have that permission.

4. Your content

You retain ownership of the photographs, selfies, captions, ratings, comments and other content you create (“User Content”). By posting User Content to Cupd., you give us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and otherwise process that content only as reasonably necessary to operate, provide, improve and promote the Cupd. Service.

You are responsible for your content and must have the necessary rights or permission to upload and share it.

5. Other people in your photos

If you upload a photograph containing another identifiable person, you should make sure that you have an appropriate basis or permission to share that photograph. Do not use Cupd. to invade another person's privacy or share content unlawfully.

6. Acceptable use

You must not use Cupd. to harass, bully, threaten or abuse; post hateful, discriminatory, sexually explicit, exploitative or seriously offensive content; promote violence or illegal activity; impersonate others; infringe intellectual property; invade privacy; distribute malicious code; attempt unauthorised access; interfere with the Service; scrape information through unauthorised automated means; spam users; or otherwise use Cupd. unlawfully.

7. Content moderation

We may investigate content or activity that is reported to us or that we reasonably believe may violate these Terms. Where appropriate, we may remove content, restrict visibility, warn a user, restrict features, suspend an account or terminate an account.

8. Reporting users or content

If you encounter content or behaviour that you believe violates these Terms, contact support@cupd.co.uk. In-app reporting features may also be made available.

9. Café information and ratings

User ratings, comments and reviews represent the views of the individual users who post them. Café information may come from users or third-party information providers, and we cannot guarantee that all information will always be complete, accurate or current.

10. Location features

Cupd. may use your device location, with your permission, to provide nearby café discovery. Location and mapping information may not always be completely accurate. You can control location access through your device settings.

11. Intellectual property

Cupd., including its branding, software, design, logos, graphics and other content created by us, is owned by or licensed to Cupd. and protected by applicable intellectual property laws.

12. Copyright and intellectual property complaints

If you believe content on Cupd. infringes your copyright or other intellectual property rights, contact support@cupd.co.uk.

13. Third-party services

Cupd. relies on third-party services to provide certain functionality, including infrastructure, authentication, location information and notifications. Third-party services may occasionally be unavailable, inaccurate or interrupted.

14. Availability of Cupd.

We aim to keep Cupd. available and functioning reliably, but we cannot promise the Service will always be available, uninterrupted or error-free. Nothing in these Terms excludes rights or remedies that cannot legally be excluded.

15. Beta and testing versions

Some versions or features may be provided as beta, preview or testing functionality. Beta features may contain errors, change without notice or be unavailable from time to time. Your statutory rights are not affected.

16. Account suspension or termination

We may restrict, suspend or terminate an account where we reasonably believe these Terms have been seriously or repeatedly breached, the account presents a security risk, the account is being used unlawfully, action is necessary to protect others or Cupd., or we are required to do so by law.

17. Deleting your account

You can request deletion of your Cupd. account through the app. Account deletion is permanent. Associated content is removed from active systems subject to information that may need to be retained for legal, security or technical reasons.

18. Our responsibility to you

Nothing in these Terms excludes or limits liability where doing so would be unlawful. Nothing in these Terms affects your statutory rights as a consumer.

19. Changes to these Terms

We may update these Terms where reasonably necessary to reflect changes to Cupd., new features, changes in law or regulation, security requirements or changes to how we operate the Service.

20. Privacy

Our Privacy Policy explains how we collect and use personal information when you use Cupd.

21. Governing law

These Terms are governed by the laws applicable in Northern Ireland. If you are a consumer, you continue to benefit from any mandatory protections available under the law that applies where you live.
